Puppy Contract

This Purchase Contract and Guarantee ("Agreement") is made and entered into by and between Jennifer Marshall of Ferocia Kennels ("Seller") and_______________________________________________ ("Buyer")   Buyer is purchasing a   [   ] male  [   ] female [   ] Active Companion  [   ] Show/Working Prospect American Bulldog, born  _________ Microchip # ___________________________ , with [  _] Full  or  [__] Limited Registration, Registration No. ____________________ through _________ (Registry), (hereafter referred to as "the puppy") from the following breeding between:

Acknowledgment of Purpose: Buyer hereby acknowledges that the puppy purchased hereunder is for Active Companion animal (pet) purposes only and is not to be used for breeding. As such, the puppy is sold with Limited Registration. Buyer’s Initials _________  

  

Buyer hereby acknowledges the puppy is merely a prospect that shows potential for show, working, or breeding purposes, and there is no guarantee of fitness or suitability for the contemplated purpose(s), or any other.  Buyer's Initials _________  

  

Puppy Reservation and Agreement to Purchase Price  

  

Buyer has agreed to purchase a [  _ ] male [  _ ] female puppy. The purchase price of the puppy is $_______________ ("Purchase Price"). Seller reserves the right, in its sole discretion, to cancel this Agreement and immediately refund all monies paid to Buyer for any reason. The Purchase Price reflects only the price of the puppy. It does not include any costs associated with shipping the puppy to Buyer, i.e., kennel/crate, health certificate and vet check, cargo airfare, flight nanny, ground transport, etc. Except as otherwise specifically stated herein, all guarantees are subject to Seller's sole discretion and Buyer's demonstration that the puppy has been maintained in a humane environment, and Buyer has provided proper nutrition (defined as a diet meeting or exceeding AAFCO standards), socialization, training and care for the puppy, including, without limitation, proper housing (not left outside on a chain or yard/kennel), and that the puppy has been vaccinated for communicable diseases, or treated for other illnesses or injuries as recommended and administered by a licensed veterinarian.   

  

HEALTH GUARANTEE   

  

All puppies are sent home with 30 days of full coverage health insurance through Trupanion Pet Insurance. Buyer must complete the sign-up paperwork for Trupanion prior to the puppy leaving Seller’s property. The puppy is guaranteed for 72 hours to be free from serious infectious diseases, such as Parvo or Distemper. If the puppy is diagnosed with a life-threatening infectious disease within 72 hours from the date the puppy left Seller’s property, and the disease can be traced to our kennel, we will reimburse Buyer for the $250 deductible through Trupanion Pet Insurance. If the puppy is treated immediately and completely after discovering the illness or disease, yet dies anyway, Seller will replace the puppy with a puppy of comparable value from the next available litter. This health guarantee is contingent upon an examination of the puppy by a licensed veterinarian and diagnosis of said illness or disease within 72 hours of the puppy leaving the Seller’s property. Vaccination and worming records will be provided by Seller upon delivery of the puppy to Buyer.

GENETIC AND CONGENITAL GUARANTEE   

  

Puppies purchased as show, working or breeding prospects are subject to a Lifetime genetic and congenital guarantee against crippling genetic defects as set forth below. Genetic defects specifically included in this Guarantee include: hip dysplasia (defined as an OFA rating of Mild, Moderate or Severe or a PennHip D.I. of greater than 0.60 or grading of Mild to Severe OA, certification and proof of submission and grading by OFA and/or PennHip required), elbow dysplasia (defined as an OFA rating of Grade 2 or 3 with proof of submission and grading by OFA required). Exclusions include but are not limited to: injuries/accidents, improper nutrition(defined as home made diets or any diet that does not meet AAFCO standards for canine nutrition) and any normal age-related maladies such as Arthritis. Other genetic diseases covered in this Guarantee include: being affected by the following known and testable diseases: NCL, Icthyosis, HUU, NM, or DM. This Guarantee does not include carrier status of these listed diseases, nor does it include any diseases that are unknown or untestable as of the date of this Agreement.    

  

Seller may, in its sole discretion, extend this guarantee to other conditions based on Seller's review and assessment of the alleged defect. In such an event, Seller reserves the right, in its sole discretion, to replace the puppy with a puppy of comparable value from the next available litter. In the event of any replacement of the puppy under this Genetic and Congenital Guarantee, Seller will require the puppy be returned to Seller, or, alternatively, that Buyer provide proof that the defective puppy has been euthanized or spayed/neutered at Buyer's expense. In the case of replacement, Buyer is responsible for all transportation related costs for the replacement puppy. This Genetic and Congenital Guarantee is void if the puppy has been bred or found to have been living in inhumane conditions and not provided with adequate care (defined as proper nutrition that meets or exceeds AAFCO standards, proper safe housing, age-appropriate activity/exercise, and vet/health care etc.).   

  

Puppies purchased as Active Companions are also subject to a Lifetime genetic and congenital health guarantee against crippling genetic defects. Genetic defects specifically included in this Guarantee include: Hip Dysplasia as graded by OFA to be Moderate or Severe, Elbow Dysplasia graded by OFA to be ED 2 or 3 that also directly affects the puppy’s quality of life and/or results in the humane euthanasia of the puppy. Certification and proof of submission and grading by OFA and/or PennHip is required.  Exclusions include but are not limited to: injuries/accidents, improper nutrition (defined as a home made diet or any diet that does not meet AAFCO guidelines for canine nutrition), and any normal age-related maladies such as Arthritis.  Other genetic defects covered in this guarantee include being affected by the following known and testable diseases: NCL, Icthyosis, HUU, NM, or DM. This Guarantee does not include carrier status of these listed diseases, nor does it include any diseases that are unknown or untestable as of the date of this Agreement.

In the event of replacement of the Puppy under this Genetic and Congenital Guarantee, Seller will require the puppy be returned to Seller, or, alternatively, that Buyer provide proof that the defective puppy has been euthanized or spayed/neutered at Buyer's expense. In the case of replacement, Buyer is responsible for all transportation related costs for the replacement puppy. This Genetic and Congenital Guarantee is void if the puppy has been bred or found to have been living in inhumane conditions and not provided with adequate care (defined as proper nutrition, housing, age-appropriate activity/exercise, and vet/health care etc).   

 

 

TEMPERAMENT GUARANTEE   

  

Seller guarantees the puppy's temperament to be sound and consistent with the breed standard for the American Bulldog as of the date ownership is transferred to Buyer. If Buyer believes the puppy's temperament is unsound, Seller reserves the right to evaluate the puppy's temperament, with consideration given to the puppy's environment and Buyer's efforts to properly socialize and train the puppy. If Seller concurs with Buyer's assessment of an

improper temperament, Seller will replace the puppy with a comparable puppy from the next available breeding. Buyer agrees that if Seller replaces the puppy, Buyer will return the puppy to Seller at Buyer's expense, including transportation costs (defined as crate/kennel, health certification/vet check, cargo airfare, flight nanny, ground transportation etc) Once the puppy has been returned to Seller, Seller has exclusive right to retain, euthanize, or to adopt/re-sell the puppy to another person. Seller reserves the right to refuse to replace the puppy if, in Seller's sole discretion, it is determined that placing another puppy with Buyer is not appropriate.  

 

RETURNS   

  

Except as otherwise expressly stated herein, Seller will not refund the Deposit or Purchase Price. Seller will accept the return of the puppy from Buyer for any reason and at any time. Buyer agrees that if he/she is unable to care for or keep the puppy that he/she will not ever surrender the puppy to a dog pound, rescue, or shelter and will return the puppy to Seller. Buyer also agrees that Buyer will first offer to rehome the puppy with Seller before rehoming the puppy to any other private party. As set forth above, the expense of returning the puppy to Seller will be paid by Buyer, and Buyer will return the puppy with all registration/ownership documentation transferring ownership back to Seller. If the puppy is returned to Seller, Buyer acknowledges that Seller will owe nothing to Buyer, and Seller will have full ownership and control of the returned puppy.   

  

BREEDING RIGHTS  

  

With the exception of puppies purchased for Active Companion animals, Buyer will have unrestricted breeding rights to the puppy. In addition, with respect to male puppies purchased from Ferocia Kennels, Buyer agrees to provide Ferocia Kennels with two stud services from the puppy, without charge, to females of Ferocia Kennels' choice. Ferocia Kennels will be responsible for payment of all breeding related costs including, if applicable, costs of collecting and shipping of semen and/or artificial insemination. For purposes of this section, Buyer agrees to make the puppy available to Seller for live cover breeding at Buyer's location, or to cooperate and coordinate with the collection and shipment of fresh chilled semen, as necessary, to accomplish these breedings.
